1. Agreement to Terms

By accessing or using the MegaByteCo website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and MegaByteCo.

2. Use of Our Services

You must be at least 18 years old to use our services. By using our services, you represent that you meet this requirement. You agree to use our services only for lawful purposes and in accordance with these terms.

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Engage in fraudulent activities or submit false information
  • Reproduce, duplicate, copy, sell, or resell any portion of our services

3. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

We reserve the right to terminate or suspend your account at any time for any reason, including violation of these terms.

4. Products and Orders

All products sold by MegaByteCo are refurbished unless otherwise stated. We make every effort to display product descriptions, images, and conditions accurately. However, we do not guarantee that all details are error-free.

By placing an order, you make an offer to purchase the selected products. We reserve the right to refuse or cancel any order for reasons including:

  • Product availability
  • Errors in product information or pricing
  • Suspected fraudulent activity
  • Violation of these terms

5. Pricing and Payment

All prices are listed in South African Rand (ZAR) and include VAT where applicable. Prices are subject to change without notice. Payment must be made in full before shipping, except for lay-buy orders which follow our lay-buy terms.

We accept various payment methods as indicated at checkout. By providing payment information, you represent that you are authorized to use the chosen payment method.

6. Lay-Buy Terms

Lay-buy allows you to reserve a device with a 50% deposit, followed by two 25% installments over 3 months. The following conditions apply:

  • Device is reserved upon receipt of the deposit
  • Installments are due as scheduled in your lay-buy agreement
  • Failure to complete payment may result in forfeiture of deposit
  • No refunds on lay-buy deposits or payments
  • Device will be shipped only after full payment is received

7. Warranty Disclaimer

All devices come with a 3-month limited warranty covering hardware defects. This warranty does not cover:

  • Physical damage caused by misuse, accident, or neglect
  • Water or liquid damage
  • Unauthorized repairs or modifications
  • Normal wear and tear
  • Software issues or data loss

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEGABYTECO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

IN NO EVENT SHALL MEGABYTECO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid for the specific product giving rise to the claim.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of MegaByteCo or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the modified terms.
